An Employment Law Void? Potential Developments in 2023 & Case Law review
Thursday 9 March 2023
In this webinar we plan to provide an update on pending changes in employment law, following a two-and-a-half-year hiatus where most legal changes related to the pandemic. To enable your business to plan, we will cover:
- The Retained EU Law (Revocation & Reform) Bill 2022-23 continues its journey through the legislative process – what will it mean for employers?
- The Employment Bill 2018 is not to be enacted, but various of its provisions are currently the subject of private members bills which have government support and are likely to become law – these include changes to the flexible working regime, employers’ liability for harassment by third parties and duty to prevent sexual harassment of employees, extension of redundancy protection for women and new parents, neonatal leave and pay, and leave for unpaid carers
- Gender identity & gender recognition continues to be a highly topical area both in terms of case law developments and legislation – The Gender Recognition Reform (Scotland) Bill was passed on 22 December 2022 – the Westminster Government has announced that it will ban this legislation under section 35 of the Scotland Act 1998, Holyrood plans to mount a legal challenge, so the issues around this are liable to continue for some time
- Industrial action is widespread in the public sector at present – the government is trying to curb this via legislation to allow agency temps to replace striking workers and to require the transport sector to maintain minimum service levels during industrial action – is this the beginning of more widespread attempts to curb strike action by the government?
There will also be a look at some relevant high profile cases which have recently been decided or await a decision by the UK Supreme Court, and a feature on some recent cases arising from the use of social media.
